1. Who these terms are with

IBC Tote Recycling NY LLC, 19-22 45th St, Astoria, NY 11105 (“we”). These terms apply to use of this website and to quotations, sales, purchases and services unless a signed agreement says otherwise.

2. Quotations

Quotations are valid for 14 days and are given per grade and quantity. Prices exclude applicable taxes. Stock is quoted subject to availability at the time of order — the used container market moves weekly and we will not promise units we may not have.

We do not price “subject to inspection”. Where we have quoted a purchase from photographs you supplied, we pay the quoted price. If the containers materially differ from the photographs, we will tell you before loading rather than re-price afterwards.

3. Grading

Our grades are defined on grades explained and that definition forms part of these terms. Grades describe condition, documentation and fitness for stated uses. They are not warranties of suitability for your specific product — that assessment is yours, and we will help with it if you tell us what the product is.

4. Prior contents — your obligation

When selling or sending containers to us you must declare their prior contents accurately and supply safety data sheets on request. This is the single obligation we cannot be flexible about. Containers with undeclared or misdeclared contents will be quarantined or returned at your cost, and you remain responsible for any cost, damage or liability arising from an inaccurate declaration.

We do not accept containers holding product, only drained containers with declared heels.

5. Certification and requalification

Where we mark a container under a competent-authority approval, that marking certifies the container at the point of release. Maintaining its authorisation afterwards — periodic leakproofness testing every 2.5 years and full inspection every 5 years under 49 CFR 180.352 — is the owner's responsibility. We will remind you if you ask us to; we will not track it for you unless you are on a fleet management agreement.

6. Collections and delivery

Free collection applies at eight units or more within our service area. Collection windows are estimates and depend on traffic, weather and site access. You must provide safe access, accurate information about dock height, gate width and forklift availability, and somebody with authority to sign the transfer note. Aborted collections caused by inaccurate site information may be charged at cost.

7. Payment, title and risk

Sales: payment before or on delivery unless credit terms are agreed in writing. Title in goods sold passes on receipt of cleared funds; risk passes on delivery. Purchases: we pay on collection or net-15 by ACH at your option, and title in containers we buy passes to us on collection.

8. Returns

Containers that do not match the grade quoted may be returned within 14 days of delivery for a refund or replacement. Containers that match their grade but do not suit your application are not returnable — which is precisely why we encourage inspection before volume purchases and will always discuss the application first.

9. Website content

The guides, calculators, decoders, charts and specifications on this site are provided in good faith for general guidance. Typical figures are typical, not universal: the UN plate on your specific container always governs. Nothing here is legal, regulatory or engineering advice, and the impact calculator produces indicative figures rather than a verified life-cycle assessment.

10. Liability

Nothing in these terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded. Subject to that, our total liability arising from any order is limited to the value of that order, and we are not liable for indirect or consequential loss including loss of profit, production or contracts.

11. Governing law

These terms are governed by the laws of the State of New York, and the courts of New York have exclusive jurisdiction.
